Terms & Conditions

1. About Us and Acceptance of Terms

Railbiking in Greece G.P. (General Partnership), hereinafter referred to as "the Company", "we", "us", or "our", is a Greek tourism company providing guided recreational railbiking experiences on a designated section of railway near Megara, Attica, Greece.

The Company is registered with the Greek General Commercial Registry (G.E.MI.) under registration number 151168603000 and with the Greek Ministry of Tourism under Tourism Business Registry (MΗ.Τ.Ε.) number 0209Ε60000019400.

The Company operates under the applicable regulatory framework and authorisations governing its tourism activities and the use of the designated railway infrastructure.

2. Reservations and Booking Confirmation

Reservations are subject to availability.

An online booking is confirmed when the relevant payment has been successfully completed and the Company has issued a booking confirmation.

Customers will normally receive a confirmation email containing the booking details and tickets.

If no confirmation email is received within 10 minutes, customers should check their spam folder and contact railbiking@gmail.com.

Customers are responsible for checking the accuracy of the booking information, including:

  • Tour date and departure time.
  • Number of participants.
  • Selected tour or experience.
  • Email address and telephone number.
  • Applicable participation requirements.

Any errors should be reported as soon as possible.

A request to correct or modify a reservation is not automatically approved until confirmed by the Company.

2.1 Lead Passenger Responsibilities

For reservations involving more than one participant, the Lead Passenger is responsible for providing accurate information and communicating the booking arrangements, safety requirements, and applicable Terms to all participants.

The Lead Passenger is not deemed to waive the independent statutory rights of other participants merely by making the booking.

2.2 Private, Corporate and Special Bookings

Private tours, corporate events, and other customised bookings may be subject to additional conditions established individually.

Any special arrangements, including cancellation deadlines, payment schedules, participant numbers, or operational requirements, must be communicated and agreed before confirmation.

Where specific agreed terms differ from these general Terms, those specific terms will apply to the relevant booking, subject to applicable law.

3. Participation Requirements

3.1 Age Restrictions

The standard minimum participation age is 12 years.

Children aged 9–11 may be considered individually, subject to prior approval by the Company.

Such approval depends on the child's height, ability to sit safely, suitability of the equipment, and the availability of an accompanying responsible adult.

Approval is not guaranteed.

Minors must be accompanied and appropriately supervised by a parent, legal guardian, or authorised responsible adult.

3.2 Height and Weight

The recommended minimum participant height is 150 cm.

The maximum permitted weight is 150 kg per seat.

All participants must be able to sit securely and use the required safety equipment correctly.

The Company may decline participation where the equipment cannot safely accommodate a participant.

3.3 Physical Ability and Accessibility

Railbiking is a recreational physical activity requiring pedalling and taking place in an outdoor railway environment.

Participants should consider their ability to participate safely.

Anyone unable to pedal independently but wishing to participate with assistance from an accompanying adult must obtain approval from the Company before booking.

Accessibility requirements or requests for reasonable assistance should be discussed with the Company before making a reservation.

Requests will be assessed individually, taking into account participants' needs, available equipment, and operational safety.

Participants are not required to disclose unnecessary medical information. Any relevant personal or health-related information will be handled in accordance with applicable data protection requirements.

3.4 Other Participation Restrictions

For safety reasons:

  • Infants and babies cannot participate.
  • Pets are not permitted.
  • Participants must be able to use the required restraints and equipment.
  • Participation while intoxicated or impaired by alcohol or drugs is prohibited.

4. Arrival, Departure and Punctuality

Participants must arrive at the designated meeting point at least 15 minutes before the scheduled departure time.

This time is required for check-in, safety instructions, equipment preparation, and other operational procedures.

Tours are scheduled to depart on time.

Late arrival does not entitle a participant to delay the departure of the group.

If a participant arrives after the required check-in time but before departure, the Tour Director or responsible staff member will determine whether participation remains operationally and safely possible.

Participation may be refused where there is insufficient time to complete the necessary procedures.

Participants who miss their departure or cannot be safely accommodated because of late arrival will normally be treated as no-shows.

4.1 No-Shows and Late Arrivals

Late arrivals and no-shows are not eligible for refunds under the standard cancellation policy, subject to applicable statutory rights.

The Company may offer a goodwill discount or an alternative booking when circumstances and availability permit.

Such arrangements are entirely voluntary and do not create an entitlement to an alternative tour or refund.

4.2 Public Transport Delays

Customers are responsible for planning sufficient travelling time to reach the meeting point.

The Company does not operate or control third-party trains, buses, taxis, or other transportation services.

Delays, cancellations, or disruptions affecting these services do not automatically exempt participants from the arrival and cancellation policies.

However, where a significant and verifiable transportation disruption occurs, the Company may consider an exceptional arrangement upon presentation of appropriate evidence.

Such exceptions are subject to availability and individual approval.

5. Cancellation Policy

All cancellation requests must be submitted by email to railbiking@gmail.com.

The applicable deadline is calculated from the scheduled departure time in Greece.

5.1 Reservations of 1–5 Participants

Customers may cancel their reservation at least 72 hours before the scheduled departure.

Eligible cancellations will receive a refund of 90% of the cancelled booking value.

A 10% cancellation fee will be retained.

Cancellations received less than 72 hours before departure are non-refundable under the standard policy, except where these Terms or applicable law provide otherwise.

5.2 Reservations of 6 or More Participants

Bookings involving six or more participants require at least seven full days' notice for cancellation.

Eligible cancellations receive a 90% refund of the cancelled booking value, with a 10% cancellation fee retained.

Cancellations received less than seven days before departure are non-refundable under the standard policy, subject to applicable statutory rights and any individually agreed arrangements.

5.3 Late Cancellations and Resold Places

Where a cancellation falls outside the applicable refund deadline, the Company is not contractually required to provide a refund merely because the reserved places are subsequently sold to other customers.

However, the Company may consider a partial refund, credit, or other goodwill arrangement if the released places are successfully resold.

Any such decision will be assessed individually and does not establish a general entitlement.

5.4 Withdrawal Rights

Bookings for leisure activities taking place on a specified date or during a specified period generally fall within the exception to the standard 14-day withdrawal right under Article 16(l) of Directive 2011/83/EU and the relevant implementing legislation.

Therefore, the cancellation deadlines in these Terms apply to such bookings, without prejudice to other mandatory consumer rights.

6. Rescheduling Policy

6.1 First Rescheduling Request

For bookings of 1–5 participants, one change of date or departure time may be requested without an administrative fee, provided the request is received at least 72 hours before the scheduled departure.

For bookings of six or more participants, the applicable notice period is seven full days.

All changes are subject to availability and confirmation.

6.2 Additional Rescheduling Requests

A second or subsequent rescheduling request may incur an administrative charge.

The applicable charge will be communicated before the change is confirmed and must be accepted by the customer.

6.3 Late Rescheduling Requests

Requests received within 72 hours of departure, or within seven days for groups of six or more, are not accepted under the standard policy.

The Company may approve exceptions in individual circumstances.

No exceptional change is effective until confirmed in writing.

6.4 Same-Day Rescheduling

Changes requested on the scheduled departure day are not permitted under the standard policy.

The Company may voluntarily consider exceptional circumstances but is not obligated to offer an alternative tour.

6.5 Price Differences

If the requested replacement tour has a different price, any additional payment, refund, or adjustment will be assessed and communicated before confirmation.

Any mandatory refund rights remain unaffected.

6.6 Confirmation of Changes

Sending a rescheduling request does not automatically cancel or modify the original reservation.

Unless and until the Company confirms the change, the existing reservation and its applicable conditions remain in effect.

7. Weather Conditions

Railbiking is an outdoor experience and may operate in variable weather conditions.

Safety decisions are made by the Company based on the conditions relevant to the railway route and the scheduled activity.

7.1 Light Rain

Tours may operate during light or intermittent rain where conditions are considered safe.

Rain protection may be provided by the Company.

A general possibility of rain does not automatically justify free cancellation or rescheduling.

7.2 Adverse Weather Forecasts

Where reliable official forecasts indicate significantly adverse weather likely to affect the scheduled tour, customers may request exceptional cancellation or rescheduling arrangements.

Relevant forecasts may include heavy rainfall, thunderstorms, severe wind, or other conditions potentially affecting the safe conduct of the activity.

Requests must be submitted before the scheduled departure, but no fixed minimum advance-notice period applies.

Customers may be asked to identify the official weather forecast supporting their request.

The Company will examine each request individually, considering the nature and timing of the forecast, expected conditions, safety concerns, and operational circumstances.

An adverse forecast does not automatically create an entitlement to a full refund or free rescheduling while the Company remains able and willing to provide the agreed service safely.

Any applicable statutory rights remain unaffected.

7.3 Extreme Heat and Ultraviolet Radiation

The Company may cancel, postpone, or adjust departure times where high temperatures or ultraviolet radiation create unacceptable health or safety risks.

Operational safety thresholds will be applied according to the Company's current safety procedures.

7.4 Company-Initiated Weather Cancellations

If the Company cancels a tour before departure because it cannot safely provide the service, affected customers may choose between:

  • A full refund of the affected booking.
  • Rescheduling to another available tour without an additional administrative fee.

8. Other Operator Cancellations

The Company may cancel or postpone a tour where necessary due to circumstances including:

  • Railway infrastructure maintenance or restrictions.
  • Instructions from competent railway or public authorities.
  • Equipment faults affecting safe operation.
  • Staff illness or emergency.
  • Significant operational interruptions.
  • Events outside the Company's reasonable control.

Where the Company cannot provide a confirmed tour and cancels it before departure, customers will be offered a full refund or an available alternative date.

The Company is not liable for unrelated third-party expenses such as independent transportation or accommodation costs, except where liability is imposed by applicable law.

9. Early Termination and Route Modifications

The Company may make changes to the tour route, stops, timing, or duration where required for safety or legitimate operational reasons.

If adverse conditions arise during a tour, the guide may stop, shorten, or terminate the activity.

The immediate priority will be participant safety and an appropriate return or other safe arrangements.

9.1 Early Termination

When a tour cannot be completed, the Company's management will assess the circumstances individually.

The assessment may consider:

  • The reason for termination.
  • The portion of the tour delivered.
  • The material difference from the originally booked experience.
  • The availability of an appropriate replacement.
  • The customer's applicable legal rights.

Depending on these factors, a full or partial refund, an alternative booking, or another appropriate remedy may be offered.

9.2 Material Changes

Where the delivered experience differs materially from the contracted service, any appropriate compensation or remedy may be assessed after the tour, once the relevant facts are known.

This assessment procedure does not postpone or remove any statutory rights to remedies.

Minor adjustments that do not materially affect the overall experience may be made as part of normal operational management.

10. Safety Rules and Participant Conduct

Railbiking takes place on railway infrastructure and requires strict adherence to safety instructions.

All participants must follow directions issued by authorised guides and staff.

The following rules apply:

  • Seatbelts must be worn whenever required, including while the railbike is moving.
  • Participants must remain seated while the vehicle is in motion.
  • Braking, speed, and spacing instructions must be followed.
  • Boarding or disembarking without authorisation is prohibited.
  • Participants must not enter restricted railway areas.
  • Protective equipment must be used whenever instructed.
  • Deliberate damage or misuse of equipment is prohibited.
  • Behaviour that endangers participants, staff, or third parties is not permitted.

10.1 Failure to Follow Safety Instructions

Where a participant fails to comply with a safety instruction, staff will normally issue a warning and provide an opportunity to comply.

If the participant continues to disregard the instruction, the Company may exclude them from the activity.

Where an immediate and serious danger exists, staff may intervene without delaying necessary protective action.

If participation is terminated because of serious or repeated misconduct, the participant will not normally be entitled to a refund, subject to applicable law.

10.2 Participation Acknowledgement

All participants must complete the required participation acknowledgement or waiver before departure.

For minors, the required documentation must be completed or authorised by the appropriate parent or legal guardian.

The acknowledgement records the participant's receipt of relevant safety information and recognition of the ordinary risks associated with the activity.

It does not remove legal rights or exempt the Company from responsibilities that cannot lawfully be excluded.

11. Prices and Payment Methods

All prices are quoted in euros (€).

The total price, including applicable taxes and mandatory charges, will be presented before payment.

Prices may vary according to tour type, departure time, selected date, capacity arrangements, or customised services.

The applicable price is the price confirmed for the reservation.

Online card transactions are processed by authorised payment providers, including Stripe.

The Company does not directly store full payment-card details.

12. Payment Disputes and Chargebacks

The Company is committed to transparent payment practices and the fair resolution of customer complaints.

Customers are encouraged to contact railbiking@gmail.com regarding any booking, refund, or payment concerns before initiating a payment dispute, where reasonably possible.

This recommendation does not limit any statutory right to dispute an unauthorised, incorrect, or otherwise legitimately contested transaction.

12.1 Booking and Payment Records

For legitimate contractual, accounting, fraud-prevention, and dispute-resolution purposes, the Company and its authorised service providers may maintain relevant records, including:

  • Booking confirmations and ticket details.
  • Payment references and transaction records.
  • The Terms & Conditions applicable at the time of purchase.
  • Records of acceptance of booking conditions, where available.
  • Cancellation and rescheduling requests.
  • Relevant correspondence with customers.
  • Check-in or attendance records.
  • Signed participation acknowledgements.
  • Records of refunds, credits, and operational cancellations.

Information will be processed and retained only where justified under applicable law and the Company's Privacy Policy.

12.2 Disputed Transactions

If a payment dispute is initiated, the Company may submit relevant evidence to the payment processor, acquiring bank, or card issuer in accordance with applicable payment-network procedures and data protection law.

Such evidence may include documentation showing that:

  • The transaction was authorised.
  • The booking was correctly confirmed.
  • The applicable cancellation terms were disclosed.
  • The booked service was made available or provided as agreed.
  • A refund or alternative arrangement had already been offered or processed.

12.3 Refunds and Bank Disputes

A payment dispute does not automatically establish that a refund is payable or that a charge is invalid.

Equally, acceptance of these Terms does not prevent a customer from asserting legitimate rights through their bank, card issuer, payment provider, or other lawful channel.

Where a charge is found to be incorrect, unauthorised, or otherwise refundable, the Company will comply with the applicable obligations.

The Company will seek to avoid duplicate reimbursement for the same transaction and will coordinate any outstanding refund with the relevant payment provider where necessary.

13. Refund Processing

Approved refunds will normally be initiated within 10–15 business days, subject to any shorter statutory deadline.

Once initiated, the time required for the funds to appear in the customer's account may depend on the payment provider and bank.

Refunds will generally be issued to the original payment method, unless another lawful arrangement is agreed.

The Company may provide refund transaction details when reasonably available to assist customers in identifying a processed refund.

14. Gift Cards and Promotional Coupons

14.1 Gift Card Validity

Gift cards are valid for 12 months from the date of purchase, subject to applicable law.

The recipient may redeem the gift card toward an eligible railbiking experience during its validity period.

14.2 Value and Redemption

Where the booking price exceeds the available gift card value, the difference must be paid.

Where the booking price is lower than the gift card value, the remaining balance may be used for another eligible reservation during the applicable validity period.

14.3 Expired Gift Cards

Unused gift cards normally expire at the end of their stated validity period, subject to mandatory legal rights.

The Company may consider exceptional extensions upon request.

Any extension is subject to individual approval and written confirmation.

14.4 Cancellation of a Gift Card Booking

Where a customer cancels a gift-card-funded reservation and is eligible for a refund under the applicable policy, the refundable value will normally be issued through a new gift card or booking code of equivalent value.

Where applicable law requires reimbursement through another method, that requirement will prevail.

14.5 Promotional Coupons

Promotional offers may have specific conditions, expiry dates, and eligibility restrictions.

These conditions will be disclosed with the promotion.

Promotional coupons generally cannot be exchanged for cash unless otherwise stated or legally required.

15. Damage to Equipment

Participants are expected to treat railbikes, safety equipment, and Company property with reasonable care.

Where equipment is damaged through misuse, intentional conduct, or negligence, the Company may assess the circumstances individually.

Any claim for compensation will take into account the cause of the damage, available evidence, the extent of the actual loss, and applicable law.

Ordinary wear and tear resulting from proper use is not the participant's responsibility.

16. Responsibility and Liability

Railbiking involves physical activity and certain inherent risks associated with moving equipment, outdoor conditions, and the railway environment.

The Company takes reasonable measures to provide safe equipment, trained staff, appropriate instructions, and operational safety procedures.

Participants are expected to follow instructions, use the equipment responsibly, and avoid exposing others to unnecessary danger.

Nothing in these Terms excludes or limits liability for death, personal injury, negligence, breach of statutory duty, or other matters to the extent such exclusion or limitation is prohibited by law.

Participation is subject to the relevant safety rules and acknowledgements, but these do not override mandatory legal protections.

17. Privacy, Photography and Video

Personal data collected during booking and participation will be processed in accordance with applicable data protection legislation and the Company's Privacy Policy.

Photography or video recording involving identifiable participants will be handled according to the relevant legal requirements and privacy notices.

Where a separate lawful basis or consent is required for promotional use, it will be obtained as appropriate.

Further details are provided in the Company's Privacy Policy.

18. Website and Intellectual Property

The website and its original content, including photographs, text, graphics, logos, and branding, are protected by applicable intellectual property laws.

Visitors may access website content for personal and non-commercial purposes.

Unauthorised copying, redistribution, or commercial exploitation of protected materials is prohibited.

Links to external websites may be provided for information and convenience.

The Company does not control the independent services or content of third-party websites and is not responsible for their actions except where applicable law provides otherwise.

19. Customer Communications

The Company uses the contact information provided during booking to send relevant confirmations, operational notices, safety information, and cancellation updates.

Customers are responsible for providing accurate contact information and checking relevant messages.

Formal cancellation and rescheduling requests must be submitted to railbiking@gmail.com.

A request is not considered approved merely because it has been submitted.

The Company will make reasonable efforts to respond promptly and to address legitimate customer enquiries and complaints.

Marketing communications will be subject to applicable privacy and electronic communications rules.

20. Force Majeure

Exceptional circumstances beyond the Company's reasonable control may prevent or delay the provision of a booked tour.

These may include severe natural events, railway infrastructure emergencies, governmental restrictions, or other comparable disruptions.

The Company will take reasonable steps to communicate with affected customers and minimise disruption.

Where a booked service cannot be delivered, the applicable cancellation, refund, and statutory consumer protections will remain in effect.

21. Applicable Law and Dispute Resolution

These Terms are governed by Greek law, without prejudice to mandatory consumer protections and applicable European Union legislation.

Customers may submit complaints directly to the Company through the designated contact email.

Where appropriate, disputes may also be referred to competent alternative dispute resolution bodies, including the Greek Consumer Ombudsman.

Any legal proceedings will take place before the courts competent under applicable law.
